The condominium "Kuznechnaya, 20/22" was created in 2016. The water supply was repaired, and the house began to be put in order. The old wrought-iron gates were restored, and a fountain was launched in the courtyard. But the cellars were abandoned.
In the front basement with an area of 60.7 sq. m, according to tenants, at first there was some kind of office. Then the room gradually turned into a shelter for the homeless. The walls are stripped, dead rats are lying around. There is no ventilation - the air ducts are clogged. And when the sewer was clogged, the basement was buried in sewage.
- We couldn't put things in order there on our own. Therefore, we decided to rent out the basement. Let the tenants make repairs there, and due to the work done, we will give them the rent, - said the chairman of the condominiums Alexander Kazakov.

We managed to hand over half of the basement. The tenants made repairs, installed electricity. And the tenants restored ventilation - the basement began to dry out, the house was gradually getting rid of the dampness. And the other part of the basement, as it turned out, has been in the ownership of the Odessa City Council since 2004.
And the co-owners decided to restore their right to it. Indeed, according to the current legislation, no one can dispose of basements, utility rooms, attics without the consent of residents - neither the mayor's office, nor the ZhKS, nor the district administration.
The general meeting decided to file a claim with the court. And to conduct the case, they turned to the lawyer Alexei Melnikov.
- Although at first some tenants did not believe that we would win this case, - Alexander Kazakov recalls. - At the city council, after all, "everything is under control."
And indeed, it turned out to be not so easy to sue for their premises. The trial began in 2018 and lasted a year and a half.

Let's take a closer look at what is included in the living area of the house and how to correctly calculate it.
All measurements are taken along the inner walls. The difficulty of calculating the footage of a room is that the room most often has an irregular shape. There may be large depressions set aside for the sleeping area, or beveled walls. The footage of individual rooms is determined in order to calculate the amount of materials for finishing. Adding their areas, you get the footage of the building as a whole. It should be the same or not very different from the figures from the construction project. In this case, we must not forget about cold storage rooms and other rooms. To find the area of a room, measure the length and width of the room, and then multiply them. If there are niches and ledges in the room, then it is better to break it into regular shapes (square, rectangle), find their footage, and then fold them. In a two-story house, a staircase of the premises and a balcony on the second floor are taken into account.
When the indentations and protrusions are small, then you can take the whole room as a regular shape (rectangle, for example) and calculate its area. And then add the footage of the niche or subtract the footage of the ledge.
Calculating the footage of a round room is a little more difficult. To do this, you need to measure its diameter and divide by 2.
The resulting value will be the radius. By multiplying pi by the radius squared, we get the area of the circle. If the room, or part of it, is a semicircle in shape, then the result must be divided in half.
If the room is triangular, then you need to subtract each side from the semiperimeter and multiply the obtained values, and then find the root. Where P is the semi-perimeter of the triangle.
If it is necessary to independently calculate the total area of the house, the owner of the building is faced with confusion in the regulatory documents. In the set of building rules (formerly SNiP), it is recommended to count the total footage, as in apartment buildings. This means that outdoor extensions (verandas and terraces) and balconies and loggias are taken into account. This approach is convenient for developers offering preschool education to their clients. The cost of housing will increase due to the total area. That is, if the contract specifies a footage of 53 sq. ., then it includes a balcony or loggia. As a result, the buyer's expectations may not be met. Therefore, the developer must inform the participant of the preschool education institution about the method of calculating the footage.
However, in residential buildings, the total footage is added up without taking into account balconies, loggias, terraces and verandas, which is regulated by the Housing Code. But if the total indicator significantly exceeds the residential one, then the rooms will be tiny, and the utility rooms (kitchen, toilet, etc.) included in the total area will be spacious.
When calculating, you should take into account a number of nuances and exclude areas:
